The purpose of these conditions is to regulate the sale and booking of nautical experiences, leisure activities (such as Jet Ski, Parasailing, Banana Boat, among others), and the acquisition of "Gift Packs" or services related to the "Club Moto Náutica".

The owner of the website reserves the right to modify or update these conditions at any time to adapt them to legislative, jurisprudential, or commercial practice developments. The applicable conditions will always be those published at the exact moment the booking or purchase is formalized.

3. Booking Process and Contract Perfection

• Legal Capacity: To contract any service through this website, the user must be of legal age (18 years old) and have the necessary legal capacity to enter into a binding contract.
• Booking Confirmation: The contract between ACTIVIDADES NÁUTICAS TORREVIEJA, S.L. and the user is formalized when the user receives, automatically or via email, the booking confirmation and the corresponding receipt or voucher.
• Accuracy of Data: The user is solely responsible for correctly entering contact details (email and mobile phone) and the desired dates. Non-receipt of confirmation due to errors in the provided data will not invalidate the purchase.

4. Prices, Taxes, and Payment Methods

The prices of the experiences are fully detailed and specified in each of the corresponding sections and service tabs of the website. In accordance with current Spanish legislation, all displayed prices include Value Added Tax (21% VAT) applicable to the products and services offered.

To guarantee maximum security in transactions (following international trust standards similar to global operators such as Viator or Booking), the website accepts the following authorized payment methods:

• Credit or Debit Card (Secure payment gateway with SSL encryption).
• Bank Transfer.
• PayPal.

5. Cancellation, Modification, and Refund Policy

5.1. Cancellations by the Customer

Individual bookings can be canceled or modified free of charge up to 24 or 48 hours before (as specified in the particular conditions of the contracted activity) the scheduled start of the experience. The customer will receive a full refund of the amount paid.

Note on No-Shows: If the customer cancels outside the established period, requests late modifications, or fails to show up at the agreed meeting point (Real Club Náutico de Torrevieja) at the indicated time, they will lose the right to any type of refund or rescheduling of the service.

5.2. Cancellations due to Weather Conditions or Force Majeure

Since the activities take place in the marine environment, safety is our absolute priority. In the event that weather conditions, sea status, or directives from maritime authorities prevent the safe performance of the activity, ACTIVIDADES NÁUTICAS TORREVIEJA, S.L. reserves the right to cancel the service unilaterally.

In this scenario, the customer will be offered, in this order:

1. An alternative date or time to carry out the activity.
2. A service of equivalent value.
3. A full and direct refund of the amount paid, without any additional claims for damages or losses arising.

6. Safety and Participation Conditions

All participants are strictly required to follow the safety rules and detailed instructions provided by the instructors, monitors, and captains of the company before and during the development of the activity.

The customer declares that they are in an optimal physical and mental health state to perform nautical activities. Participation is strictly prohibited for persons under the influence of alcohol, drugs, narcotics, or medications that alter motor or cognitive capacities.

For rental services that require a nautical license valid in Spain, the customer must physically present the original document before boarding. Failure to present the required documentation will cancel the service without the right to a refund.

7. Delivery of Vouchers, Gift Packs, and Associated Costs

As a general rule, booking vouchers and "Gift Packs" are issued and sent immediately and free of charge in digital format to the email address provided by the user.

In the event that a physical order or corporate material is generated from our website, our company will fully assume the standard shipping costs, provided that customers do not request an express or special service (such as urgent shipments or international shipping), whose additional costs will be borne by the buyer.

8. Intellectual Property and Limitation of Liability

All software, HTML/CSS code, high-fidelity imagery, brands, logos, and designs of this website portal are the property of ACTIVIDADES NÁUTICAS TORREVIEJA, S.L. or its licensors and are protected by intellectual property laws. Its reproduction or commercial use without express written authorization is strictly prohibited.

Access to this website is the sole responsibility of the users. Simple access does not imply entering into any type of direct commercial relationship between the company and the user until a valid contract and payment are formalized.

9. Applicable Law and Jurisdiction

These General Conditions are governed by Spanish law. For the resolution of any dispute or litigation that may arise from access to this website or the contracting of its services, the parties expressly submit to the jurisdiction of the Courts and Tribunals of the city of Torrevieja (Alicante), waiving any other jurisdiction that may correspond to them, unless the applicable consumer and user law imperatively determines otherwise.
